Planning Inspectorate Appeals

Background

Greendale Property Limited have lodged two separate appeals with the Planning Inspectorate (PINS). The first relates to the non-determination by Southwark Council for their initial planning application 16/AP/1232. The council are supposed to make a decision about large planning applications within a certain timescale, and this is long overdue, hence the appeal.

The second appeal is in relation to the council’s rejection of their application to remove some S106 clauses and restrictive covenants regarding the current stadium and astro turf: 16/AP/4051.

Procedure

Apparently the council have been in discussions with the property developers about various aspects of their original application. These appeals now take the matter out of the hands of Southwark Council and one assumes that any discussions about the applications have now ended. The decision about both applications is now with PINS. It is likely that the Southwark Planning Committee will meet to decide what their decision *would have been* had the appeals not been lodged. This could include an opportunity for people in favour and in opposition of the applications to state their cases for the usual 3 minutes. The belated decision by the council will then go forward as evidence to PINS.

PINS have written to Southwark Council and told them that the appeals will take the form of an Inquiry, which it states is “the most formal of the procedures” (see page 5 of Procedural Guide to Planning Appeals in England ). They say that this will take longer than 3 days and it should be open to the public.

** UPDATE ** The appeals will be held at the council offices in Tooley St on 12th December 2017 at 10am for a maximum of 8 days. The inspector has been named as David Prentis.

Commenting

All of the previous comments about the applications that were sent to Southwark will now be passed on to PINS who will take them into consideration. However, it  is possible to amend or add to your comments. Any comments must be sent in by 7th March 2017.
